General Terms and Conditions
1.1 These General Terms and Conditions (GTC) regulate the relationship between Max Felchlin AG and its customers in the online shop for private individuals (B2C). They are a mandatory part of every contract concluded between Max Felchlin AG and a customer. Subsidiary agreements, assurances or changes to these GTC must be in writing. These GTC therefore apply to the ordering and delivery of standard items from Max Felchlin AG.
1.2 The additional information listed separately regarding the terms of delivery/shipping costs and terms of payment as well as the statements on data protection (data protection declaration) and legal notices form an integral part of these General Terms and Conditions.
2. CONCLUSION OF CONTRACT The customer orders online. The offer to conclude a purchase contract lies in the binding sending of the order after the customer has placed the products in his shopping cart and confirmed his selection by clicking on the button labeled "buy". The customer can change his details at any time before clicking the "Pay" button. The contract is concluded when Max Felchlin AG sends an order confirmation by email.
3. ORDER CHANGES The customer's order is binding for him. After placing the order, the customer cannot make any changes to the order. Any existing right of withdrawal remains unaffected.
4. TERMS OF DELIVERY
4.1 The items ordered are delivered at the customer's expense. The delivery and shipping costs are shown separately on the invoice.
4.2 Domestic deliveries (Switzerland, Principality of Liechtenstein) are made by Swiss Post. PostPac Priority or Swiss-Express “Moon”.
4.3 Max Felchlin AG shall not be liable if the goods cannot be delivered or are delivered late as a result of the customer providing an incorrect delivery address or if the recipient is absent.
4.4 Max Felchlin AG is not liable for delays in delivery for which it is not responsible, e.g. due to force majeure, traffic jams, bad weather conditions, unusual, unforeseeable detention by the customs authorities, etc., and they do not entitle the customer to withdraw from the purchase contract or to claim damages.
4.5 Collection from the factory shop is possible during opening hours
Monday to Friday 09:00 - 12:00 / 13:30 - 18:00 and Saturday 10:00 - 16:00
5. PRIZES
5.1 The prices for the products offered apply that are listed on the day the customer places the order. The prices are binding until the order is confirmed by Max Felchlin AG or for the period specified in the order confirmation. All prices are gross prices in Swiss francs (including VAT).
5.2 We reserve the right to change prices as a result of changes in taxes, fees, charges or shipping costs.
6. PAYMENT TERMS
6.1 Orders in the online shop must be paid for by credit card (Mastercard and Visa), Twint or PostFinance. The payments will be debited immediately after conclusion of the contract.
7. CONTROL OF THE GOODS / COMPLAINTS
7.1 The recipient undertakes to check the goods for completeness and condition immediately upon receipt. Any complaints regarding quality and completeness must be reported to Max Felchlin AG immediately, but no later than within 48 hours of delivery, otherwise the delivery is deemed to have been accepted.
7.2 Max Felchlin AG is not liable for transport damage and damage resulting from improper storage of the goods after acceptance by the customer or his assistants.
8. RETURN, EXCHANGE AND RIGHT OF WITHDRAWAL
8.1 Products that have been delivered to the customer completely and undamaged cannot be returned or exchanged.
8.2 Products returned to Max Felchlin AG after an unsuccessful delivery attempt by delivery services cannot be delivered to the customer again for food law reasons. In this case, the customer must place a new paid order.
9. PRIVACY
9.1 The data necessary for the business transaction are stored and passed on to the company commissioned with the delivery as part of the contract processing. Otherwise, stored data will not be passed on to third-party companies, with the exception of the credit check offices and, if necessary, for the collection of receivables. The data is used for customer care within Max Felchlin AG in Germany.
9.2 Order-related and other correspondence by Max Felchlin AG can be done electronically. We expressly point out the security risks associated with data transmission via e-mail, which are not under the influence of Max Felchlin AG, such as virus transmission, damage to data, data loss or access by third parties. With the order and the indication of his e-mail address, the customer allows Max Felchlin AG to send documents and other data electronically and also with unencrypted e-mails.
9.3 All personal data provided by the Buyer will be collected and processed exclusively for the provision and processing of services and obligations in connection with the purchase of goods and services from the Max Felchlin AG range, in each case in accordance with the applicable data protection regulations, in particular the GDPR and in accordance with national accompanying laws (e.g. DSG). Details on data collection, processing and protection can be found in the Felchlin Privacy Policy.
10. GOVERNING LAW AND JURISDICTION
10.1 Swiss law, to the exclusion of the Vienna Sales Convention (CISG), applies exclusively to the contracts.
10.2 The exclusive place of jurisdiction is Schwyz, subject to appeals to the Swiss Federal Court.
